1
Parties and Subject of the Agreement
The service provider under this Agreement is
35MOYA TURİZM İNŞAAT GIDA NAKLİYE SANAYİ VE TİCARET
LİMİTED ŞİRKETİ
.
The services are provided within the operations of
Journey Friends Travel Agency and under the
35 MOYA VIP Transfer service brand.
The “Customer” means the natural or legal person
requesting transfer services for themselves or for
passengers on whose behalf the reservation is made.
The subject of this Agreement is the provision of the
transfer or private transportation service requested by
the Customer and specified in the reservation confirmation,
subject to the terms agreed between the parties.
2
Scope of Service
Depending on the reservation, the service may include
airport transfers, hotel transfers, private urban or
intercity transfers, chauffeur-driven vehicle allocation,
group transportation, corporate transportation, wedding
and special-event transportation, or other private
transportation services agreed between the parties.
The exact scope of the service is determined according
to the date, time, route, number of passengers, vehicle
category, additional services and any other terms stated
in the reservation confirmation or separately agreed
between the parties.
Standard transfer services provided by
35 MOYA VIP Transfer are private transfers.
Unless expressly stated otherwise in the reservation,
the transfer is not shared with other customers.
3
Reservation and Confirmation
Submission of a form through the website, or an enquiry
regarding price or availability through WhatsApp,
telephone, email or another communication channel,
does not by itself constitute a confirmed reservation.
A reservation becomes confirmed once the service provider
confirms the date, time, route, vehicle or vehicle category
and other essential reservation details.
Confirmation sent to the Customer via WhatsApp, email,
reservation form, voucher/confirmation document or another
written communication channel may be used to determine
the scope of the reservation.
The Customer is responsible for reviewing the information
contained in the reservation confirmation and notifying
the service provider as soon as possible of any error
or omission.
4
Customer's Obligation to Provide Information
The Customer is responsible for providing accurate,
current and complete information necessary for the
proper planning and performance of the service.
Depending on the nature of the reservation, the following
information may be requested:
- Passenger's full name,
- Telephone number and contact details,
- Transfer date and time,
- Pick-up and drop-off locations,
- Flight number and flight information,
- Number of passengers,
- Luggage information,
-
Requirement for an infant seat, child seat or booster seat,
-
Other special requests required for planning the service.
Where incorrect or incomplete information results in
delay, incorrect planning, inability to perform the
service or the need for additional operations, any
resulting additional costs may be charged to the Customer.
5
Vehicle Category and Vehicle Replacement
A Vito, Sprinter, midibus, coach or another appropriate
vehicle category may be assigned at the time of reservation.
Vehicle capacity is planned according to the number of
passengers, amount of luggage, route and operational
requirements.
Unless a specific make, model, model year, colour,
registration plate or particular vehicle has been
expressly guaranteed in writing, vehicle images displayed
on the website, social media or promotional materials
may be representative of the relevant vehicle category.
In the event of operational requirements, technical
malfunction, maintenance, traffic conditions, delay from
a previous assignment or another justified reason, the
originally planned vehicle may be replaced with another
vehicle of the same or an equivalent category that is
suitable in terms of passenger capacity and the essential
nature of the service.
If a particular vehicle or vehicle model is an
essential condition of the reservation for the Customer,
this must be expressly stated before the reservation
and confirmed in writing.
6
Pricing and Payment
The transfer price may be determined according to the
route, vehicle category, number of passengers, service
duration, special requests, additional stops and overall
scope of the service.
Unless otherwise stated, the price communicated to the
Customer before or at the time of reservation confirmation
applies to the confirmed scope of service.
Payment may be made, according to the method offered
during the reservation process or agreed between the
parties, in the vehicle, by bank transfer/EFT, by credit
or debit card through a POS terminal, mobile POS,
payment link or another payment method accepted by
the company.
If direct online payment is made available through the
website in the future, payment transactions may be
processed through the relevant bank, payment institution
or secure payment service provider.
Additional stops, route changes, additional waiting,
vehicle changes or expansion of the service scope
requested by the Customer after confirmation may
be subject to an additional charge.
7
Airport Transfers and Flight Information
For airport meet-and-greet services, it is important
that the Customer provides the correct flight number
and flight date.
Where accurate flight information has been provided,
the actual flight status may be taken into account for
operational planning. However, the Customer should notify
the service provider as soon as possible in the event of
a flight cancellation, flight change, travel on a
different flight or another material change that may
affect the service.
The airport meeting point and vehicle or driver details
may be communicated to the Customer before the reservation
or closer to the transfer time, depending on operational
requirements.
8
Waiting Times and No-Show
AIRPORT ARRIVAL TRANSFER
Maximum 60 Minutes
The standard waiting period is a maximum of
60 minutes from the actual landing time of
the flight.
OTHER PICK-UP LOCATIONS
Maximum 15 Minutes
At hotels, residences, workplaces or other
pick-up locations, the standard waiting period
is a maximum of 15 minutes from the scheduled
pick-up time.
If the passenger experiences a delay, they are expected
to contact the service provider by telephone or WhatsApp
before the applicable waiting period expires.
Where timely notice is provided, additional waiting may
be considered depending on the vehicle and driver's
subsequent schedule and operational availability.
Additional waiting is not guaranteed and may be subject
to an additional charge where applicable.
If the passenger does not arrive at the meeting point
within the applicable period, cannot be reached and does
not provide information regarding the delay, the
reservation may be treated as a No-Show.
9
Cancellation, Refund and Reservation Amendments
Reservation cancellations, refunds, date or time changes,
flight changes, No-Show situations and other related
matters are assessed in accordance with the
Cancellation, Refund & Amendment Policy
published on the website.
Unless otherwise specifically agreed for standard
reservations:
-
Cancellations made at least 12 hours before the
transfer are eligible for a 100% refund,
-
Cancellations made less than 12 hours but at least
6 hours before the transfer are eligible for a
50% refund,
-
No refund is made for cancellations received less
than 6 hours before the transfer,
-
No refund is made in the event of a No-Show.
Special cancellation, payment or amendment conditions
communicated before reservation may apply to corporate
services, group transfers, weddings and special events,
tours or dedicated vehicle allocations.
10
Passengers, Luggage and Child Seats
The Customer must accurately state the number of
passengers and the amount of luggage that may affect
the planning of the service.
Oversized, excessive or non-standard luggage must be
declared before the reservation. Where undeclared luggage
causes the planned vehicle capacity to be insufficient,
any additional operation or vehicle requirement may be
subject to an additional charge.
Requests for an infant seat, child seat or booster seat
should be made at the time of reservation or sufficiently
in advance. The child's age or required seat type may be
requested in order to arrange an appropriate seat.
11
Passenger Obligations
During the service, passengers are required to comply
with reasonable instructions given by the driver and
relevant personnel for the purpose of safe transportation.
-
Seat belts must be used,
-
The vehicle and its equipment must not be damaged,
-
Passengers must refrain from behaviour that may
distract the driver or endanger driving safety,
-
Items or substances whose transportation is
prohibited by law must not be brought into the vehicle,
-
Material changes affecting the transfer schedule
should be communicated as soon as possible.
If a passenger's behaviour seriously endangers driving
safety, the safety of others or the lawful performance
of the service, the service may be suspended or
terminated depending on the circumstances of the case.
12
Circumstances Affecting Performance of the Service
Traffic congestion, road closures, accidents, weather
conditions, security measures, actions of public
authorities, flight operations or other events outside
the reasonable control of the service provider may
affect the duration or route of the transfer.
In such circumstances, the driver or operations team
may use an appropriate alternative route or operational
plan in order to protect passenger safety and continue
the service.
Particularly for transfers to the airport, it is important
that the Customer selects a pick-up time that provides
sufficient time before the scheduled flight departure.
13
Force Majeure
Natural disasters, extraordinary weather conditions,
war, civil disturbances, decisions of public authorities,
road or area closures, extraordinary disruptions to
transportation systems and similar events outside the
reasonable control of the parties may be considered
force majeure.
In the event of force majeure, an alternative route,
date or time will be considered first where reasonably
possible. Any amendment or refund will be assessed by
taking into account the specific circumstances, the
stage of performance of the service, costs already
incurred and applicable law.
14
Protection of Personal Data
Personal data obtained in connection with the reservation
and performance of the service is processed in accordance
with Turkish Law No. 6698 on the Protection of Personal
Data (KVKK) and the applicable legislation.
Detailed information regarding the purposes and legal
grounds for processing personal data, parties to whom
data may be transferred and the rights of the data
subject is provided in the
KVKK Privacy Notice
published on the website.
15
Liability and Nature of the Service
The service provider is responsible for performing the
transfer service covered by the confirmed reservation
with reasonable care and within its operational
capabilities.
Delays directly resulting from circumstances outside the
reasonable control of the service provider, including
traffic, weather conditions, actions of public authorities,
road closures or disruptions to flight or transportation
systems, will be assessed according to the circumstances
of each case.
Nothing in this Agreement shall be interpreted as
excluding any rights of the parties that cannot lawfully
be restricted under applicable legislation.
16
Consumer Rights
Mandatory rights available to Customers who qualify as
consumers under applicable consumer legislation remain
reserved.
This Agreement is not intended to restrict any statutory
right of application, claim or other right available to
a consumer that cannot legally be excluded by contract.
In consumer transactions, the Customer may apply to the
competent Consumer Arbitration Committees, Consumer Courts
and other authorities legally competent under the
applicable legislation, depending on the nature and
value of the dispute.
17
Governing Law and Dispute Resolution
This Agreement shall be interpreted and applied in
accordance with the laws of the Republic of Türkiye.
In consumer transactions, the consumer's right to apply
to the competent Consumer Arbitration Committees,
Consumer Courts and other legally competent authorities
under applicable legislation remains reserved.
For disputes that do not constitute consumer
transactions and in which the parties are legally
permitted to enter into a valid jurisdiction agreement,
the Courts and Enforcement Offices of İzmir shall
have jurisdiction.
18
Acceptance and Entry into Effect
This Agreement becomes applicable to the relevant
reservation upon confirmation of the reservation by the
Customer, purchase of the service, payment or acceptance
of the contractual terms presented electronically, as
applicable.
Where an electronic checkbox is used on the reservation
form for acceptance of the Agreement, the Customer may
be provided with access to the relevant texts and a means
to expressly indicate acceptance.
Acceptance of the Transfer Service Agreement,
acknowledgement of the KVKK Privacy Notice and any
explicit consent that may be required under data
protection law are separate legal processes.
Acknowledgement that the KVKK Privacy Notice has
been read should not be treated as general explicit
consent to the processing of personal data.

arising under applicable legislation remain reserved.
